As her primary battle with socialist Senator Bernie Sanders drags on toward a contested convention, and the FBI investigation into her private email server continues, the last thing Hillary Clinton needed was more bad headlines. But this morning, Politico is reporting that the State Department’s inspector general has concluded that Clinton violated the agency’s email rules by using a private email server during her tenure as Secretary of State.

The Inspector General’s report also includes an email exchange between Clinton and top aide Huma Abedin, who has reportedly been interviewed as part of the FBI’s investigation into the server, where Clinton expressed her concern that using a government email would make her communications “accessible.” This is the clearest evidence yet that Clinton had her private server set up specifically to circumvent open records laws.

If House Democrats were not already concerned about the possibility of the Clinton email scandal upending the race for the top of the Democrat ticket, they should be now. Clinton’s behavior has now been found to have violated State Department rules. If the FBI concludes that Clinton violated the law and indicts her, the Democrat primary will be thrown into chaos, further diminishing House Democrats’ chances of significant pickups in November.

NRCC Comment: “Now that the Department of State has determined that FBI target Hillary Clinton’s conduct violated agency rules, House Democrats must decide whether they will continue to stand with her at a contested convention. As the prospect of Clinton running her general election campaign from a jail cell becomes more and more likely, House Democrats’ dreams of riding her coattails to a majority have become a nightmare for downballot candidates.” – Bob Salera, NRCC Spokesman

Hillary Clinton expressed concern in November 2010 about the risk of her personal emails becoming accessible after one of her top aides said they needed to discuss putting her on the State Department’s email system.

The revelation of the exchange between Clinton and Huma Abedin was included in a report from the State Department’s inspector general that was released to lawmakers on Wednesday.

The report concluded that Clinton violated the agency’s email rules when she chose to exclusively use a private email server during her four years at State Department and did not promptly turn over records after she departed the agency.

The document also included some details of an exchange between Clinton and Abedin, who both chose not to cooperate with the IG’s investigation.

“In November 2010, Secretary Clinton and her Deputy Chief of Staff for Operations discussed the fact that Secretary Clinton’s emails to Department employees were not being received,” the report said. “The Deputy Chief of Staff emailed the Secretary that “we should talk about putting you on state email or releasing your email address to the department so you are not going to spam.” In response, the Secretary wrote, “Let’s get separate address or device but I don’t want any risk of the personal being accessible.”
