Not to mention, our deficits are exploding.
We simply cannot afford this disastrous law.
I demand you repeal this government takeover of healthcare.

<strong>THE CHALLENGE</strong> The company is one of thousands of small businesses that employ more than 50 full-time employees and thus will be required to offer <a title="Recent and archival health news about health insurance and managed care." href="http://topics.nytimes.com/top/news/health/diseasesconditionsandhealthtopics/health_insurance_and_managed_care/index.html?inline=nyt-classifier">health insurance</a> to their workers — or pay into a government fund — beginning Jan. 1. Rachel Shein and Steve Pilarski, the married owners of the bakery, which employs 95 people, estimate this could cost their business up to $108,000, and they are weighing their options as the date approaches. “Our revenues are about $8 million, but the food business is a low-margin industry so cutting $108,000 out of our profits, which are just over $200,000, is a big deal,” said Ms. Shein, who is the chief executive. They are evaluating different ways to comply with the new law and finance the expense.<br />
&nbsp;<br />
<strong>THE BACKGROUND </strong>Ms. Shein and Mr. Pilarski bought their first bakery, a maker of scones, 16 years ago. Their business grew along with the popularity of coffee shops, and they expanded their product line to include other pastries.<br />
&nbsp;<br />
During the recession, the coffee shop business contracted, so they found new customers among hotels and hospitals, but the cost of servicing different types of businesses and developing new products to meet their needs eroded profits. At the same time, gasoline and ingredient prices went up and vendors tightened payment terms. Still, the couple persevered by providing an array of freshly baked goods and offering product variety and consolidated delivery, simplifying things for their customers.<br />
&nbsp;<br />
With the recession behind them, Ms. Shein and Mr. Pilarski are trying to rebuild their profitability. Baked in the Sun produces nearly 200,000 items a day — almost 200 different products, including brownies, coffee cakes, muffins and cookies — in an 18,500-square-foot baking facility in San Marcos, Calif. The goods are delivered to coffee shops, schools, hotels and hospitals in the San Diego area.<br />
&nbsp;<br />
<strong>THE OPTIONS </strong>Ms. Shein is contemplating several options to comply with the Affordable Care Act’s business mandate.<br />
&nbsp;<br />
Option One is to provide the insurance. According to the law, Ms. Shein will have to offer health insurance or, most likely, pay a penalty, and she estimates the insurance will cost up to $108,000 a year for 90 employees (managers have insurance already).<br />
&nbsp;<br />
This is just an estimate, she said, because the insurance companies have not yet created and set a price on plans that meet the law’s requirement for minimum care. She estimates a cost of $200 per employee a month, of which the bakery would pay half and the employee would pay half. Employees can choose not to participate in the plan if they are covered elsewhere or for other reasons, so it is unlikely they will all sign up.<br />
&nbsp;<br />
Option Two is to not offer health insurance and let employees find coverage elsewhere, perhaps on one of the new government exchanges. Under this option, the company will probably have to pay the mandated “employer shared responsibility payment” to the government.<br />
&nbsp;<br />
The cost to the business would be $2,000 per employee a year, but the law exempts the first 30 employees, so the total would be $130,000 per year for a 95-person company. One benefit of this option is that the company would not have to take on the burden or expense of managing the insurance plan, which Ms. Shein estimates would take $10,000 of staff time.<br />
&nbsp;<br />
One way to cover the costs associated with the new law would be to raise the price of each item sold about 4 percent and pass the costs along to buyers. “It’s ironic that our success meant we could grow,” Ms. Shein said, “and now we will be competing against smaller companies, with 50 employees or fewer, who will be able to charge less per item because they don’t have the financial burden of health insurance.” Prices are currently similar among local competitors, Ms. Shein said, and she says she believes the increase in her prices could affect her sales, possibly significantly.<br />
&nbsp;<br />
Ms. Shein is considering a third option: outsourcing certain jobs to reduce the staff, because businesses with 50 or fewer employees will be exempt from the penalty. “We can outsource the cleaning and make the drivers independent contractors,” she said, “and we can cut the least profitable delivery routes, least profitable accounts or reduce the variety of items we create.”<br />
&nbsp;<br />
It is important for Ms. Shein to make a decision soon on staff levels because the number of full-time employees a business has in 2013 will determine its status in 2014. If the business has 50 or more full-time, or full-time equivalent, employees, it has to provide insurance to any staff members who work 30 hours or more a week. Companies can average their number of employees across the full 12 months in 2013 to see whether they meet the threshold, or they can instead calculate the number of full-time employees by using any six-consecutive-month period in 2013.<br />
&nbsp;<br />
Ms. Shein said she believed all workers should have health insurance, and she and her husband had wrestled with the problem for years. “We have offered health insurance to our employees in the past,” she said, “for preventive care, for financial protection, and because it doesn’t make sense for taxpayers when they end up in the emergency room.”<br />
&nbsp;<br />
However, she has found many of her employees resistant to coverage that requires an employee contribution. “They are mostly young and healthy,” she said. “They don’t have a lot of extra money, and they would rather have a bit more in their paycheck than health insurance.” Also, she said, some of her Mexican employees prefer to go south of the border for inexpensive health care when they need it.<br />
&nbsp;<br />
<strong>WHAT OTHERS SAY </strong>John G. Ebenger, an accountant with <a title="The firm’s Web site." href="http://www.bpbcpa.com/">Berkowitz Pollack Brant Advisors and Accountants</a> in Miami: “It is a challenging situation, especially since the details have not been fully worked out. The bakery could opt to bite the bullet and pay the penalty next year with plans to revisit the types of insurance that become available in 2014. With a year to plan, insurance companies will come up with more options for employers.”<br />
&nbsp;<br />

Offering insurance won’t cost much more than the penalty, and in an industry where many of their competitors don’t offer insurance, they could advertise themselves as a better place to work.”&lt;<br />
&nbsp;<br />
Jody Hall, owner of <a title="The company Web site." href="http://www.cupcakeroyale.com/">Cupcake Royale</a>, with 80 employees in Seattle, and a leader of the<a title="The organization Web site." href="http://mainstreetalliance.org/">Main Street Alliance</a>, a national network of small-business groups: “I’d recommend offering health care insurance for full-time employees, like we do at Cupcake Royale, as part of our responsibility to help strengthen the health of our employees, our community, and our business.<br />
&nbsp;<br />
“Ms. Shein is probably overestimating her costs because not all employees will use the health insurance she offers. At our bakery only about half our employees use the health insurance we provide. Some are under 26 and covered by parents, others have spouses with coverage, and some just choose not to take it. Small businesses like mine who have been offering health care will be better off when all businesses are paying into the system because the cost increases will slow down.”<br />

Just like a typical three-year-old, the Affordable Care Act (a.k.a. Obamacare) is undergoing a period of rapid growth and development. For those who still cling to the nostalgic notion that once legislation is passed and signed the lawmaking stops, think again. The single largest piece of regulation ever passed has grown 10-fold in its short life, to more than 20,000 pages standing seven feet tall,  since the President signed it into law on March 23, 2010.<br />
 &nbsp;<br />
Some of the mandates, such as covering preexisting conditions in kids under 19 years old, took effect immediately, while many others continue to be phased in, with the most pronounced changes set to come at the start of 2014. As that day fast approaches, the flow of anecdotes and concerns seems to be mounting.<br />
 &nbsp;<br />
Just today, the Wall Street journal is reporting that insurers are forecasting premium increases of up to 50% for some families, while Investor&#8217;s Business Daily compiled a list of 10 Disturbing Facts About Obamacare, most of which have to do with unforeseen costs, while all of them point to the simple fact that this monstrous law is still one great big pile of unknowns.<br />
 &nbsp;<br />
&#8220;We&#8217;re nowhere near the implementation of the Affordable Care Act,&#8221; says Paul Keckley, Executive Director of the Deloitte Center for Health Solutions, in the attached video. Putting aside price and the many other practical questions that surround the law for a moment, Keckley says the creation of State-run insurance exchanges and the expansion of medicaid are the two major logistical obstacles that still need to be cleared. &#8220;States have to make a calculated bet as to whether, in the long-term, expansion of medicaid is a good thing or a bad thing.&#8221;<br />
 &nbsp;<br />
As for the mass market impacts and the impact Obamacare will have on businesses large and small, Keckley says &#8220;there&#8217;s a suspicion on the part of employers that the law doesn&#8217;t really bend the cost curve and it doesn&#8217;t really fundamentally restructure the system.&#8221;<br />
 &nbsp;<br />
With just nine months until full implementation, a lot is still unknown. Even nationally renowned experts such as Keckley concede there&#8217;s a high degree of mystery that shrouds this ever-growing body of law. For example, he says the jury is still out over whether paying doctors for outcomes (results) instead of volume (procedures), reduces costs.<br />
 &nbsp;<br />
&#8220;We consider the law to be a work in progress,&#8221; Keckley says. &#8220;We know that it will increase access (by 29-32 million people), but we don&#8217;t know if it will reduce costs simultaneously. That&#8217;s the big bet.&#8221;<br />

Last week I posted <a href="http://www.washingtonpost.com/blogs/wonkblog/wp/2013/03/14/want-obamacare-heres-the-21-page-draft-application/">a copy </a>of the draft application for Obamacare benefits, which clocks in at a hefty 21 pages.<br />
&nbsp;<br />
Consumer advocates and Wonkblog commenters had similar questions: Why on earth would the federal government create such a complex form to obtain a public benefit?<br />
&nbsp;<br />
For me, at least, the flowchart below provides a bit of an answer. It comes from the National Association of Insurance Commissioners, which represents the regulators who oversee each state’s insurance market. It is an attempt to draw up the most basic, simple questions to determine eligibility for insurance subsidies or Medicaid.<br />

It can take as many as six questions just to determine an individual’s ability to buy insurance. An eight-question chain sorts out eligibility to eschew employer coverage and buy an individual plan with a tax credit instead.<br />

The reason goes all the way back to Washington and an unintended consequence from medical reform.<br />
&nbsp;<br />
Dog owner Lori Heiselman was surprised where her veterinarian posted a warning on Facebook.<br />
&nbsp;<br />
The notice read: “Because medical equipment and supplies will be going up in cost, that extra expense will have to passed on to the customers.”<br />
&nbsp;<br />
So Lori is already tightening her belt to pay for the increase in her dog’s care. Though she doesn’t like it, she’s willing to pay more for her pets.<br />
&nbsp;<br />
“They’re very important. They’re members of the family,” said Heiselman.<br />
&nbsp;<br />
Why the increase? Its part of a new 2.3-percent federal excise tax on certain medical devices that just went into effect. The tax will help fund the Patient Protection and Affordable Care Act, commonly known as Obamacare, intended for people, not pets. Manufacturers pay the tax, but a recent survey found more than half plan to pass it along.<br />
&nbsp;<br />
Some vets say they can’t afford it. Dr. Mike Hatcher is one of them. He explained, “I’m extremely concerned how this is going to be a hidden tax to our consumers that is going to be passed on.”<br />
&nbsp;<br />
How does this work? Medical devices used only on animals are exempt. However, items including IV pumps, sterile scalpels and anesthesia equipment, which are medical devices that have a dual use, meaning they can be used on people and animals, will be taxed. Hatcher said, “Putting off an equipment purchase is something that can terribly affect our clients’ ability to have quality care.”<br />
&nbsp;<br />
The American Veterinary Medical Association represents 82,000 vets. At this point, they don’t know how much this new tax will indirectly cost them. The organizations members are waiting to hear from more device makers.<br />
&nbsp;<br />
Dr. Mark Lutschaunig is the director of the Governmental Relations Division of the American Veterinary Medical Association.<br />
&nbsp;<br />
“Congress never intended for this tax to impact veterinarian medicine and unfortunately it has, and I think that’s very unfortunate that veterinarian medicine now is subsidizing human health care,” said Dr. Lutschaunig.<br />
&nbsp;<br />
Congressional sources who worked on the Affordable Care Act said lawmakers tried to exclude vets from being affected by the dual use medical devices tax, but it was too complicated.<br />
&nbsp;<br />
Carol Smock knows about complications. She founded a charity that helps struggling pet owners pay for vet care. Smock started Brown Dog Foundation after struggling to pay for her chocolate lab’s medical bills while she was unemployed. Her organization is a 501c3 public charity that provides funding to families who find themselves in similar situations: A sick pet that would likely respond to treatment, but due to an unforeseen circumstance, there is not enough money immediately available to make it happen.<br />
&nbsp;<br />
Smock is afraid The Brown Dog Foundation is going to be overwhelmed with requests.<br />
&nbsp;<br />
“The impact this price increase is going to have on any of those families I think will be pretty devastating.”<br />
&nbsp;<br />
Lori Heiselman said she worries about other families too, but she’ll find the money for her four-legged friends. “We’ll just have to cut back somewhere else.”<br />
&nbsp;<br />
Veterinarians say, if your pet is sick or acting strangely, don’t delay care. That could just cause medical problems to get worse.<br />
&nbsp;<br />
If you’re concerned with the cost of vet care, be sure to talk with your vet about payment plans or other financial options.<br />

On a conference call last week, CEO and founder John Schnatter (a Mitt Romney supporter and fundraiser) said the health care law&#8217;s changes — set to go into effect in 2014 — will result in higher costs for the company — which they vowed to pass onto consumers.<br />
&nbsp;<br />
&#8220;Our best estimate is that the Obamacare will cost 11 to 14 cents per pizza, or 15 to 20 cents per order from a corporate basis,&#8221; Schnatter said.<br />
&nbsp;<br />
&#8220;We&#8217;re not supportive of Obamacare, like most businesses in our industry. But our business model and unit economics are about as ideal as you can get for a food company to absorb Obamacare,&#8221; he said.<br />
&nbsp;<br />
&#8220;If Obamacare is in fact not repealed, we will find tactics to shallow out any Obamacare costs and core strategies to pass that cost onto consumers in order to protect our shareholders best interests,&#8221; Schnatter vowed.<br />
&nbsp;<br />
Schnatter is not the first pizza magnate to bemoan proposed or actual changes to federal health care. In 1993, future presidential candidate Herman Cain charged that Bill Clinton&#8217;s proposed health care reform law would cost his company Godfather&#8217;s Pizza money and jobs.<br />
&nbsp;<br />
&#8220;For many many businesses like mine, the cost of your plan is simply a cost that will cause us to eliminate jobs,&#8221; Cain told Clinton in a famous exchange.<br />
