Hayworth Keeps Independence Party Line in NY-19 Ruling

September 22, 2010

A judge has chucked out a challenge to Republican Nan Hayworth’s bid to carry the Independence Party line in her challenge to incumbent Democratic NY-19 Rep. John Hall, Team Hayworth announced.

Hall’s lawyers had gone to court in an attempt to knock Hayworth off the line, claiming her petitions had invalid signatures and alleging other improprieties.

Team Hayworth lauded the ruling as a “vindication,” and communications director Douglas Cunningham said in a statement, “I think we now know why John Hall was so eager to disseminate fabrications about what was actually going on in the courtroom in Albany. He would rather talk about anything else except his record, which is one of lost jobs and failed big-government programs. I think it’s clear what the voters want to focus on, and that’s renewing our economy, fixing the abysmal jobs picture and restraining a government that’s too big and too costly.”

Responded Hall Campaign Manager Patrick McGarrity:

“We respect Justice Michael C. Lynch’s decision to dismiss the lawsuit regarding the Independence Party line and proudly move forward to victory on the Democratic and Working Family Party lines.

“But we absolutely reject Nan Hayorth’s claims of ‘vindication.’ Hundreds of signatures were invalidated by the court, including every single one submitted by Hayworth campaign manager John Hicks. Mr. Hicks collected signatures which were submitted to the New York State Board of Elections. During his testimony his actions were admonished by the judge and the court ruled his submitted signatures invalid. That is hardly vindication.”
